Gamers have varying choices among themselves, but one thing we all can agree upon is ‘things that irritate us the most while playing games’. For example, Online games, in particular, are prone to cheating hacks provided by a third party that is hated by almost the entire community.
Destiny 2 is no stranger to this. Players have encountered many cheaters in competitive playlists like the Trials of Osiris. Game developer Bungie decided to get its hands dirty and has started the practice of suing cheat developers. However, one of those cheat makers had requested to dismiss the lawsuit.
Cheat-Making site AimJunkies’ request for dismissal of the lawsuit brought against them by Destiny 2 developer Bungie, has been denied by the judge.
They had also issued subpoenas to Valve, PayPal, and Google in hopes of showing that its cheats do not infringe on Bungie’s intellectual properties. The judge in charge denied AimJunkies’ request to dismiss due to a “lack of personal jurisdiction and improper venue.”
They decided that Bungie had adequately shown grounds for a copyright claim in its refiling and that AimJunkies failed to address its “improper venue” claim in its motion. The judge also scolded AimJunkies’ lawyer for filing a dismissal that was 13 pages long, one page over the 12-page limit under local rules.
Interestingly, this is the second time Bungie is going after Aimjunkies. In April, AimJunkies convinced a judge to dismiss the case after Bungie failed to adequately explain how its hacks constituted an illegal copy of Destiny 2’s code.
The cheat-makers also suggested that they might sue the Bungie employee who had purchased their cheats and handed them over to Bungie for decompilation, violating their terms of service.
Coming back to the current case, the court has set the trial date for July 2023. However, we will have to wait to see if AimJunkies takes this case all the way to trial. Let’s be honest, cheating is a selfish thing to do as no one except the cheaters enjoy the experience.
So, Bungie’s decision to sue the cheat makers is not only right but also good business. Bungie had recently settled one of the lawsuits as it was awarded $13.5 million in a settlement against Elite Boss Tech, another Destiny 2 cheat provider.
